Islamic will

Here at KORT, we are working on doing all the tough work for you. You will be able to access a FREE Will writing service which is completely compliant with Islamic law and domestic law – and it will just takes 20 minutes to complete.

What is an Islamic will?

An Islamic will is a legally binding file that states to whom a person will be leaving their possessions (property, belongings, cash) to upon their return to Allah (SWT). This is a bequest.

This will consider 2 groups of people:

Ascendants: Including your partner (husband/wife) and parents.

Descendants: Your kids, brother or sisters and grandchildren (full brother or sisters and half-siblings).

A will can likewise include bequests for charitable purposes.

As a Muslim, you should distribute your wealth after you die according to the sharia (Islamic law). If you reside in the UK, then having a Will is a must. This is since if you pass away without one, your assets will be dispersed according to domestic law, not Islamic law.

You need to have a Will that adheres to both English law and Islamic law in order for it to be both legitimate in the UK and in accordance with Islam. Passing away without a will in the UK expenses typically ₤9,700 in lost assets and costs.

What is the Law for Wills in Islam?

In Islam, a will must be made by the person whist they live. A will is produced for the purposes of organizing ones residential or commercial property and assets, after their death, for the advantage of others or for charitable organizations such as KORT.

REASONS YOU NEED TO MAKE AN ISLAMIC WILL:

  1. It is your religious responsibility. Prophet Muhammad (ﷺ) said, “It is not acceptable for any Muslim who has something to will to remain for 2 nights without having his last will and testament written and kept all set with him.” [Bukhari]

  1. You can conserve typically hundreds of countless pounds in inheritance tax– the inheritance tax rate is 40% and uses to all things you have more than ₤ 325,000 (with some exceptions).

  1. You can avoid major household disagreements by developing a lawfully binding will that specifies how your estate ought to be dispersed.

  1. You can save your inheritors actually thousands in extra-legal, court, and estate tax payments (₤9,700 is the typical cost of dying without a will according to mainstream will-writers).

  1. You can save your inheritors and administrators a great deal of time, stress, inconvenience and concern by plainly laying out who is an administrator, who is your kids’ guardian, and who gets what. You might think that your wife/husband is going to sort things out for you, however what if a family member starts disputing that after you’re gone? Clarity is constantly best.

  1. You do not want to leave something like the guardianship of your children to the family courts– who might decide in favour of someone you would not appreciate with.

  1. If you are not lawfully married to your spouse (for instance, if you’ve just done a nikah), then writing a will guarantees your spouse will actually inherit something. It will likewise ensure that your partner gets a share of your family home– which she/he will not otherwise under the laws of intestacy.

  1. They will not instantly inherit anything without a will if you have stepchildren, foster children, or other dependents who are not blood relations.

  1. It’s a beneficial workout for you to reflect properly on death. It likewise indicates you’re required into action from an administrative point of view. How will your executor ever discover that random savings account you opened where you’ve still got ₤300 in?

  1. And maybe most notably, as a Muslim you can designate up to one third of your estate towards a Sadaqah Jariyah (continuing charity) that will benefit you in the next life. Simply as Prophet Muhammad (saw) stated, “When an individual dies, his deeds come to an end except for 3: Sadaqah Jariyah (a continuous charity), or knowledge from which benefit is acquired, or a righteous child who hopes for him.” [Muslim]

Charity given during your lifetime is better

Abu Dawood narrated a marfoo’ hadith from Abu Sa’eed al-Khudri, which was classed as saheeh by Ibn Hibbaan, which says: “If a man were to give one dirham in charity when he is alive and in good health, that is better for him than giving one hundred when he is dying.”.

AQEEQAH AND ISLAM

WHAT IS AQEEQAH?

The word Aqeeqah refers to that animal which is slaughtered on the seventh day upon the birth of a child. Aqeeqah is a way of showing gratitude and being thankful to Allah for blessing us with a child. The practice of Aqeeqah is encouraged in Islam. This is understood from a hadith narrated by Ibn Abbas (RA) that the Prophet (peace be upon him) carried out the Aqeeqah of Hassan (RA) and Hussain (RA) by slaughtering one ram each in their names.

RULINGS OF AQEEQAH?

According to narrations in the books of hadeeth, the scholars of Islam have mentioned the following rulings regarding Aqeeqah:

  • 2 goats should be sacrificed in the child’s name if the child is a boy.
  • 1 goat should be sacrificed in the child’s name if the child is a girl.
  • The hair of the newborn child must be shaved.
  • Saffron should be applied to the newborn child’s head.
  • It is Sunnah to give charity on the amount of the weight of the child’s hair equivalent to the value of silver. (i.e., if a child’s shaved hair weighed 5 grams, it is Sunnah to give the value of 5 grams worth of silver to charity as Sadaqah)
  • The child should be named by the seventh day.
  • All the laws pertaining to Qurbani relating to the animal will apply to Aqeeqah.
  • If for some reason only one animal is slaughtered on behalf of a boy then the Aqeeqah would be completed.
  • There are no restrictions as to how the meat of the animal should be used i.e., the person can keep it for himself, feed his family, or share it amongst the poor and needy.

WHAT DAY SHOULD AQEEQAH BE DONE?

The preferred day to slaughter an animal would be on the seventh day after the birth of the child. If for any circumstance someone forgot to do so, then he can do it on the following seventh day and so on (14th, 21st, 28th day). Although it is preferable to perform the Aqeeqah on the seventh day after the child is born, there is no harm in performing it before the seventh day or later.

Not everyone is fortunate to have children. Many couples try for years yet have no children. So, if you have been given the gift of a child from Allah, be grateful, and perform the Aqeeqah for the pleasure of Allah. May Allah accept everyone’s Aqeeqah and raise their children on deen and May Allah make our children follow the Sunnah of our Beloved Prophet Mohammed (peace be upon him). Ameen!

Sadaqah Jariyah

Allah invites us to this very specific investment through Sadaqah Jariyah. One of the most fantastic concepts in Islam is Sadaqah Jariyah. Sadaqah Jariyah is merely a one-time financial investment with repeating advantages and benefits. It is a one-off charity but with repeating and continuous reward. It is this type of Sadaqah which the Prophet (PBUH) stated will continuously benefit an individual even after their death. The Prophet (PBUH) said:

When a person dies, all their deeds end except 3:
a continuing charity, valuable knowledge and a child who prays for them,
(Hadith, Muslim).

Muslims are eager to offer charity which will continue to have the advantage to individuals after their death and continue to earn them a reward.

Any charity which continues to have positive results on an individual or community in the long-lasting can be thought about a Sadaqah Jariyah. Some examples consist of:

  • Building medical facilities, homes, and schools.
  • Setting up long lasting water
  • Cultivating crops which supplies food for several years to come.
  • Helping households begin a company which continues generating revenue for future generations.
  • Building a location to praise Allah.

In truth, we are encouraged in the Sunnah and from the practices of the Sahabah to consider Sadaqah Jariyah.

Sad ibn Abi Waqqas sought permission to donate his estate in charity, he was offered an allowance to do so, up to one-third of his estate. When a Muslim pass away, two-thirds are fixed for the needs of his inheritors.

These two-thirds are left behind for the worldly needs of others. Nevertheless, one-third is for us which we can take with us in the next life to help us for eternity.

This can take place through offering one third into Sadaqah Jariyah.
The example of those who spend their wealth in the way of Allah is like a seed [of grain] which grows seven spikes; in each spike is a hundred grains. And Allah multiplies [His reward] for whom He wills. And Allah is all-Encompassing and Knowing.
[Qur’an 2:261]

This verse artistically narrates the multiplicity of reward for giving Sadaqah. Providing a single pound in Sadaqah draws numerous rewards. In truth, the impact of Sadaqah has favourable ramifications on the recipient as that pound travels through the system for the advantage of others. Also, this verse tells us that whatever we offer, has the possible to increase seven hundred times. That indicates the return on investment is 700%!

We should constantly try to find more opportunities and moments to get more benefit and the pleasure of Allah. Whatever we do now, will most surely benefit us in the Hereafter, and be a method to bless us in this world.
